Breyer

Does anybody else think Justice Breyer timed his retirement so his replacement could get through the Democratically controlled Senate before the 2022 elections? That suggests that the Democrats believe that they might lose their majority in the Senate.

If so, it is comforting that the Democrats are not comfortable falsifying the counting in the face of overwhelming evidence to the contrary. If they were sure they could get away with cheating they would not have pulled Breyer's transition ahead.

If I were on Biden's team, I would ask Senators Manchin and Sinema for a long list of Justices that they found acceptable BEFORE I flopped the mackerel on the table.

  1. Sinema is pretty blue, she votes in lock step with the party with very few exceptions. Check her voting record if you don't believe me. She's not stupid, though, and sees that getting rid of the filibuster would kneecap her party in a year.

  2. This was planned out thoroughly. Breyer didn't announce his retirement without telling Biden's handlers first and the replacement has already been decided on. Breyer is a flaming liberal. His replacement will make him look positively conservative.

  3. Breyer saw the handwriting on the wall and has reportedly been under pressure to retire. The party is so eager to get going they announced it before he was ready, apparently cheesing him off royally. But I wouldn't be on his replacement being better by comparison, either in expertise, knowledge of the law, or liberalism.

    1. It's not just a little ironic that Biden's stated intention of appointing an African-American woman to the position is a pre-condition that the Supreme Court has found unconstitutional.

  4. ERJ, this had 100% to do with timing. It suggests to me that the current Occupant's party thinks they are going to get a shellacking in the mid-terms. If the former Occupant's party wanted to actually motivate voters to get out, they would hold out until the election is complete. Courts have run with 8 justices before.

  5. Of course it is about timing. They learned a lesson ( for a change). RBG didnt retire because she Knew that Hillary would win. She could stay on the court till they carried her out. Ooopppsie, didnt work out so well. Not wanting to make that mistake again. Breyer is forced out. Retire or be found dead from suicide .

  6. Of course it's about politics and timing... Realistically, he should have retired years ago; I'm surprised he didn't retire last year when there was a better chance of getting a replacement through easily.

    As mentioned above, I'm not sure any nomination will be as smooth as some think; this group seems to score own goals alot.
