Gary Harrington of Eagle Point, Oregon is suing the State of Oregon for damages due to flooding from the excessive rains this past year.
For those of you with short memories, Mr. Harrington was sentenced to jail-time for collecting rain-water. The State of Oregon contended that the water that fell on his 170 acre property belonged to them and won in court.
With that precedent, Mr. Harrison's lawyers claim that the State of Oregon did not control their property, the rain-fall, and are therefore liable for the damages it incurred just as they would be if they did not control a vicious dog.
Mr Harrington is suing for $7000 for the damage done to his personal vehicle and for $6.3 Billion in punitive damages.
I hope he wins. The icing on the cake would be to give the District Attorney/ State Attorney and prosecutor jail time as well. Or just shoot them.
ReplyDeleteWay back when - had to be at least 50 years ago - a similar issue developed in Virginia: motorist hit a deer, killed it, and was loading it into his car when the highway patrol showed up. The HP trooper said "you can't do that, the deer belongs to Virginia and we will give it to (insert local charity name here) to use for food." Motorist said, OK if it's the state's deer, the state is liable for damages to my vehicle, went to court and won the case. Ever since then if you hit a deer in Virginia it's your deer.
ReplyDeleteLogically he should prevail. In reality the system isn't driven by facts or logic. And the odds are good his suit will be dismissed outright for somehing like "lack of standing" or some other meager excuse. He will be lucky if the judges doesn't label him a vexatious litigant and stick him with court costs.

ReplyDeleteI hope he wins but agree with Dan and Old NFO. As far as the State hammering him for 'capturing' rain, the rain was eventually going to enter the state lands anyway so it is not as if he had stolen the rain and the state would be irretrievably damaged.
