So, do Sotomayor and Kagan get the bums' rush?

It looks like the Democrats will lose both the Senate and the White House.

Will they make Sotomayor and Kagan the same offer they made Biden (a deal they couldn't refuse) so they can stuff "seasoned", hyper-progressive, 40-year-old jurists into the highest court in the land?

It would be quite a show if they did. "Yes, you are our champions...until it becomes inconvenient. And then you are fungible and can be replaced in a matter of weeks."

Yes-sir. Nothing shows respect for the individual like flushing them down the toilet like so many turds.

    "Who will replace Justice Thomas?"

    1. Thomas is who I think will be heavily pressured to leave within the next 18 months. Get him out now so the Republicans can get who they want. A new ( future) Democrat Senate has made it clear they will hound that man ( and his wife). Better to leave now, take the retirement, and stop being in the Democrat bullseye.

  3. Does the (now) Lame Duck legislature have the votes to replace a Supreme Court Justice?

    1. Maybe... The bigger issue would be whether they have enough time to do it.
      Unless they have it planned and issue a resignation today, I doubt it.
      Given the cluelessness of the Dems recently, I doubt anyone who mattered was thinking ahead like this.

  4. I believe a Supreme Court Justice is appointed for life. I can't believe they'd quit voluntarily going from a big frog to no frog at all.

  5. The Left now has a lot of experience in forcing someone out in order to run someone else without really vetting them.

    BTW, "retired" Supreme Court Justices often keep serving as substitute judges (senior status) in the Circuit Courts of Appeals.

  8. I think it's too late in the game to make that play.

    The smart move would be for 70-year-old Sotomayor to retire immediately (on the assumption that she is more at risk of incapacitation during the next 4 years). Kagan is still young and might very well outlive Trump.

  9. Only the two "justices" (sic) can decide to step down....pressure or no. But replacing them could possibly be thwarted till after the inauguration by a concerted effort. I fully expect Thomas to step down once Trump is in office. He's certainly no spring chicken.
